Acknowledgment of services
The Happy Home Company provides in-home 'Home Reset' concierge services. By booking a visit, you (the client, homeowner, or authorized resident) acknowledge you have read and agree to this Waiver & Release on behalf of yourself and all members of your household.
Assumption of risk & release
To the fullest extent permitted by law, you release and hold harmless The Happy Home Company, its owners, employees, and specialists from any and all claims, demands, or damages arising out of or related to the services, except those caused by our gross negligence or willful misconduct.
Limitation of liability
Our total liability for any claim relating to a visit is limited to the amount you paid for that visit, or the applicable amount recoverable under our commercial liability insurance, whichever the parties agree applies. We are not responsible for indirect, incidental, or consequential damages.
Pre-existing conditions & normal wear
We are not responsible for pre-existing damage, deferred maintenance, ordinary wear, or the failure of aged or fragile items, fixtures, or appliances. See the Pre-existing Damage & Property Condition acknowledgment.
Indemnification
You agree to indemnify The Happy Home Company against claims brought by third parties arising from conditions in the home that were not disclosed to us.
